Tennessee lawmakers have been tough in recent years. Our state now has some of the toughest DWI penalties in the nation.

A DUI conviction is permanent and may not be expunged.

DUI (first offense), class A misdemeanor:

  • Fine: $350 to $1,500
  • Eleven months and 29 days in jail (all but 48 hours may be suspended)
  • Eleven months and 29 days' probation
  • Probation: complete a state-approved alcohol treatment program
  • One-year license revocation (restricted license may be available)

DUI (second offense), class A misdemeanor:

  • Fine: $600 to $3,500
  • Eleven months and 29 days in jail (all but 45 days may be suspended)
  • May serve up to 28 days in a treatment program, concurrent with jail time
  • Probation: 11 months and 29 days, must complete a state-approved alcohol treatment program
  • Two-year license revocation (restricted license during second year)

DUI (third offense), class A misdemeanor:

  • Fine: $1,100 to $10,000
  • Eleven months and 29 days in jail (all but 120 days may be suspended)
  • Probation: 11 months and 29 days, must complete a state-approved alcohol treatment program
  • Three to 10 years' license revocation (not eligible for restricted license)

DUI (fourth offense), class E felony:

  • Fine: $3,000 to $15,000
  • One to six years in jail or prison, 150 days minimum
  • Five to 10 years' license revocation (not eligible for restricted license)
